Residential Rehabilitation Guidelines

Revised Residential Rehabilitation Guidelines As of June 1, 2019

The Village of Freeport Residential Rehabilitation Assistance Program has been designed to improve the quality of standard housing units within the Village. To achieve this objective, the Village has received Community Development Block Grant funds, which is made available within certain federal guidelines, to be directed to homeowners in the form of a grant. Participation in the Program is limited to low and moderate-income homeowners living within the Village of Freeport who plan to carry out necessary eligible improvements.

Eligibility Criteria

All applicants must meet the following criteria to be considered eligible for participation in the Residential Rehabilitation Program:

  • The property must be located within the Inc. Village of Freeport
  • The property must be owner-occupied and must be considered low/moderate income as per the following HUD guidelines:

*Changed or updated periodically. If your total household income is equal to or below the above guidelines, you may be eligible for assistance.

Income Limits

The annual income limits for this program are established according to §813.106 of the U.S. Department of Housing and Urban Development (HUD) regulations. Annual income shall include, but is not limited to:

  • Anticipated total income from all sources received by the family head and spouse (even if temporarily absent) and by each additional member of the family over the age of 18 years
  • The full amount (before any payroll deductions) of all wages and salaries, overtime pay, commissions, fees, tips and bonuses, and other compensation for personal services
  • The net income derived from the operation of a business or profession
  • The full amount of periodic payments received from social security, annuities, insurance policies, retirement funds, pensions, disability or death benefits and other similar types of period receipts, including lump-sum payment for the delayed start of a periodic payment
  • Payments in lieu of earnings, such as unemployment and disability compensation, worker's compensation, and severance pay
  • Welfare assistance
  • Alimony and child support payments

Eligibility Improvements

Rehabilitation may include but is not necessarily limited to the following improvements.

  • Roofing and siding improvements
  • Replacement and/or repair of doors
  • Incipient code violations or preventative maintenance efforts which should be undertaken to avoid more costly future action. Items in this category include: heating, plumbing and electrical improvements; exterior works such as roofing, siding, porch and step repairs, paved walks and interior work
  • Architectural Barrier Removal (ABR) Handicap Ramps

Repayment Method

The project shall be funded from the Community Development Block Grant Program. The funding shall be a grant provided (A) that the owner remains in the house for a period of one year from the date of completion of the work and (B) the owner shall remain in ownership for a total of five years from the date of completion of the work.

Upon the occurrence of any of the foregoing events during the five (5) year Recapture Period, the amount to be repaid to the County will be computed as follows:

  • The amount to be captured during the first year of this agreement shall be 100% of the Recapture Obligation;
  • The following schedule will constitute the Recapture Obligation:

 a) year 2 -- 40% of the Recapture Obligation

 b) year 3 -- 30% of the Recapture Obligation

 c) year 4 -- 20% of the Recapture Obligation

 d) year 5 -- 10% of the Recapture Obligation


A Chattel mortgage and UCC-1 Certificate or subordinate mortgage and mortgage note is signed by the owner in order to protect the funds provided for under the terms of the grant agreement. At the end of the five (5) year term, a mortgage satisfaction will be executed for filing with Nassau County. The filing cost of the mortgage and satisfaction is the responsibility of the homeowner.

Funding for this program is limited and property owners must meet the income thresholds as set forth in the Eligibility Criteria of these guidelines.
